In plain English
Operators of establishments where animals are kept, egg sellers among them, must register the holding in the national database (BDN) before they start (D.Lgs. 134/2022, art. 5, in force in this wording since 27 September 2022). The family-holding category covers up to 50 poultry (4 if ratites), kept only for own consumption or private household use with no commercial activity except as Regulation (EC) No 852/2004 allows (art. 2(1)(f); operating manual, ch. 2.4); which egg sales that allows was not established.
A sourced reading of the rules in Italy, not legal advice. Rules change; confirm with the Ministry of Agriculture (MASAF) for egg marketing; your local health authority (ASL) for holdings and hygiene before you sell.
Do you need a license?
- Operators of establishments where animals are kept must meet the registration duties before they start, and ask for registration in the national database (BDN) as the operating manual sets out (D.Lgs. 134/2022, art. 5(1)-(2)); the local health authority (ASL) assesses the documents received, for the assignment of a unique registration number.art. 5(6)
- A family holding (allevamento familiare) keeps the species and maximum numbers set in the operating manual, for poultry at most 50 birds (4 if ratites), only for own consumption or private household use, without commercial activity save the exceptions in Regulation (EC) No 852/2004, and without passing animals on except for immediate slaughter or with prior authorisation.art. 2(1)(f); manual, ch. 2.4
- The operating manual says a holding that goes over the limit, or uses the animals differently, no longer fits the family-holding definition, and the operator must notify the change of production type (manual, ch. 2.4).
- An Italian route for registering a small egg seller as a food business was not found in the texts read (D.Lgs. 134/2022 art. 2 and 5; D.Lgs. 27/2021 art. 2; the operating manual, ch. 2.1.1 and 2.4). The Ministry of Health, the regions, the autonomous provinces and the ASLs are the designated competent authorities for official controls, each within its competences.D.Lgs. 27/2021, art. 2(1), in force in this wording since 26 March 2021
- The operating manual was read in its 2023 text, as published by a local health authority; the January 2025 amending decree does not change the passages cited here, and later changes were not checked.
Where you can sell
From home or the farm
The 2009 decree exempts eggs the producer sells directly to the final consumer at the place of production from the marketing standards, and such eggs are not graded (D.M. 11 dicembre 2009, art. 2(1)). Its title says it was made under Regulations (EC) No 1234/2007 and 589/2008; Regulation (EU) 2023/2465 repealed Regulation (EC) No 589/2008, and Regione Lazio's egg packing-centre page (updated or verified on 30 July 2026) still lists the 2009 decree among its reference laws. Neither the 2025 egg-stamping decree (recitals and arts 1-2) nor its 2024 predecessor (recitals and art. 1) cites or repeals it. Whether the decree still applies was not established.
Farmers markets
The same 2009 decree extends its exemption to sales at a local public market or door to door within 10 km of the place of production, and says eggs sold at a local public market must still carry the producer code unless they come from producers with up to 50 laying hens who show their name and address at the point of sale (art. 1(2)(c) and art. 2(1)). Whether the decree still applies was not established.
Stores and restaurants
Shops and restaurants are not among the 2009 decree's direct-sale channels, and the EU option it uses covers only sales to the final consumer at the farm, a local public market or the door, so eggs for shops or restaurants fall under the EU marketing standards.
